CESAR Releases Report on Review of Data in Golden Glade Cress Proposed Listing Under the ESA, the FWS is not required to collect additional data upon which to make a listing determination.  However, in a listing determination, a lack of data does not provide the FWS with the ability to substitute surmise or speculation in the place of data.  The FWS has, with no scientific basis, assumed no other golden gladecress populations exist throughout the entire weches formations in order to make a determination that the golden glade cress is endangered...
